Who we are
The controller of your personal data is the company FOGDOG Ltd., Company ID: 04201701, with registered office at Osadni 26, 17000 Prague 4, Czceh Republic.
The purpose of this personal data processing policy is to provide information on what personal data Martin Prošek, as a data controller, processes about data subjects, for what purposes and for how long Martin Prošek processes these personal data in accordance with applicable law, to whom and for what reason it may be transferred, and also to inform about the rights of data subjects in connection with the processing of their personal data.
This policy is issued in accordance with Regulation (EU) 2016/679, on the protection of natural persons with regard to the processing of personal data (hereinafter referred to as “GDPR”) in order to ensure the information obligation of FOGDOG Ltd. as a controller under Article 13 of the GDPR, and is effective from 17 May 2019.
What personal data we collect and why we collect it
We only process personal data that you provide to us yourself (usually when filling out an order or in the course of other business dealings) or that is otherwise provided to us with your consent. In particular, we process the following personal data:
+ name and surname, or the name of the business name of the natural person – entrepreneur,
+ billing and delivery address,
+ identification number (ID number) and tax identification number (TIN),
+ bank details,
+ telephone number and e-mail address.
During your visits to our website, we may collect information about these visits, such as your IP address, date and time of access, information about your operating system, web browser, your behavior on our website. If you visit our website from your mobile phone, tablet, etc., we may also process information about that device. However, in these cases we try as far as possible to anonymise this information so that it cannot be attributed to a specific person.
For what purpose and for what reason we process your personal data
We process your personal data because it is necessary for the performance of the purchase contract we conclude between us and for the purposes of our legitimate interests, i.e. in particular for the purpose of
+ the handling and delivery of the shipment;
+ resolving any problems in the delivery of the goods, complaints or returns,
+ providing customer care and improving our services;
+ negotiating special contractual terms;
+ simplifying the ordering of goods (“pre-filling” of data);
+ sending you offers and other commercial communications as appropriate, unless you opt out of receiving these newsletters by setting up your user profile;
+ opportunities for you to participate in marketing contests, etc.;
+ if necessary and unless we agree, for the purpose of defending against the exercise of your rights or for the purpose of exercising our rights against you.
We process your personal data because it is necessary to comply with the legal obligations we have, in particular in the course of inspections by public authorities or in the performance of other obligations, such as the obligation to provide such data to law enforcement authorities, etc.
Contact forms
When visitors submit a completed contact form through this website, the data displayed on the form is collected, as well as the visitor’s IP address and the user agent string defining the browser, which helps to detect spam. The form is sent directly to the e-shop’s email.

You can also request the removal of any personal data we hold about you. This option does not include data that we are obliged to keep for administrative, legal or security reasons.

+ The right to access your personal data.
You have the right of access to personal data, which includes the right to obtain confirmation from us as to whether we are processing your personal data, as well as information about the purposes of the processing, the categories of personal data concerned, the recipients to whom the personal data has been or will be disclosed, the intended duration of the processing, the existence of the right to request from us the rectification or erasure of your personal data or the restriction of its processing or to object to such processing, and the right to lodge a complaint with a supervisory authority.

+ Right to rectification of inaccurate data.
You have the right to rectification of inaccurate personal data we process about you. On the other hand, however, you are obliged to notify us of any changes to your personal data and to provide evidence that such a change has occurred. You are also obliged to cooperate with us if we discover that the personal data we process about you is inaccurate. We will make the correction without undue delay, but always taking into account the given technical possibilities.
+ Right to erasure.
You have the right to erasure of the personal data concerning you unless we can demonstrate that there are legitimate grounds for processing the personal data.
+ Right to restriction of processing.
If you contest the accuracy of the personal data, the grounds for processing or object to the processing, you have the right to restrict the processing of the personal data until your complaint is resolved.
+ Right to notification of rectification, erasure or restriction of processing.
In the event of rectification, erasure or restriction of the processing of your personal data, you have the right to have us notify you of such record. You have the right to object to the processing of your personal data on the grounds of our legitimate interest. If we do not demonstrate to you that there is a compelling legitimate reason for the processing which overrides your interests, rights and freedoms, we will terminate the processing of your personal data without undue delay.

We will be glad if you address any shortcomings related to the processing of personal data with us first. We strive to protect your personal data as much as possible and it is certainly not our aim to harm your rights in the slightest, so we will pay close attention to your complaints. If you still wish to contact a supervisory authority, you have the right to contact the Data Protection Authority (www.uoou.cz) with complaints regarding the processing of your personal data.

How we protect your personal data
The data controller declares that personal data will be processed only within the scope and for the purpose specified. Personal data is under constant physical, electronic and procedural control. Personal data will be accessed by authorised employees and collaborators in the field, payroll and IT. Data will only be processed on the Controller’s resources and stored on the Controller’s premises. Data is not transferred to 3rd countries or international organisations, only to the extent stated above, i.e. only to countries or organisations within the Privacy Shield.
